What is a conflict of interest?
A conflict of interest exists when a lawyer’s representation of one client is directly adverse to another client or when the lawyer’s representation of one client is materially limited by the lawyer’s responsibilities to another client or to a third person, or by the lawyer’s own interests.
How do we identify and manage conflicts of interest?
We have implemented the following procedures to identify and manage conflicts of interest:
- Screening: Before accepting a new client, we conduct a thorough conflict check to ensure that we do not represent a client whose interests are adverse to those of our existing clients. We use various searches to conduct these checks.
- Confidentiality: We maintain strict confidentiality of client information to prevent conflicts of interest from arising. We do not disclose any confidential information of one client to another client or to any third party, except as required by law.
- Informed consent: In some cases, we may determine that there is a potential conflict of interest but that we can still represent both clients with their informed consent. We will explain the potential conflict of interest to both clients and obtain their written consent before proceeding with the representation.
- Withdrawal: If we identify a conflict of interest that cannot be managed or mitigated, we will withdraw from representing one or both clients, as necessary.
- Training: We provide regular training to our attorneys and staff on conflict of interest issues to ensure that they are aware of their ethical obligations and the procedures we have in place to manage conflicts of interest.
